The website and app operate as an online store specializing in the sale of children’s clothing, shoes, accessories, and baby products from the French brand Orchestra. They allow users to purchase the products they desire according to the terms and conditions outlined in this document and the Privacy Policy.
1. Definitions
Unless the context requires otherwise, the following terms in this agreement have the meanings stated:
• “App”, “Website”, “Orchestra.ps”, or “We”: refers to the Orchestra.ps online store specializing in children’s fashion and products.
• “User” or “You”: means the person visiting or using the website or app, or registering an account.
• “Subscriber”: any person who creates an account in the app or website.
• “Services”: refers to the services we provide, including selling children’s clothing, shoes, accessories, and baby products from the Orchestra brand.
• “Agreement”: refers to this document including all terms and conditions, privacy policy, and any related policies.
• “Annexes to the Agreement”: includes all product descriptions published on the website or app and any supplementary contracts.
• “Parties to the Agreement”: refers to the app, the user, and anyone subject to these terms.
2. Legal Nature of Terms, Conditions, and Policies
1. This agreement and its annexes constitute the complete and final agreement between the app and the user.
2. This agreement is a legally binding contract for all parties and cannot be nullified as long as its legal effects apply.
3. The user acknowledges that this agreement is the sole reference between the parties.
4. Product descriptions are an integral part of this agreement.
5. Supplementary contracts and policies are considered essential parts of the agreement.
6. Any amendments are subject to the same legal validity as this agreement.
3. Consent and Legal Eligibility
1. Users must be 13 years or older.
2. The app reserves the right to restrict or cancel accounts of users below the required age.
3. Users must have the legal capacity to enter into contracts.
4. Using the app constitutes full agreement to this agreement.
5. Accessing the app is considered an electronic signature.
4. Communications
1. You agree to receive communications via email, mobile, or in-app notifications.
2. Electronic communications are legally equivalent to written communications.
3. Promotional messages are sent after obtaining your consent during registration.
4. You can opt out of promotional messages by contacting us.
5. Any notice to the app must be sent through official channels within the app.
5. Intellectual Property Rights
1. The Orchestra.ps trademark and all content displayed (images, text, products, designs) are fully protected as intellectual property.
2. All images and products are either owned by the app or licensed from the Orchestra brand.
3. Data compilation related to the app is protected under local and international copyright laws.
6. Granted Licenses
1. The app grants you a limited license to use Orchestra.ps services.
2. Copying or using the data for commercial purposes is prohibited.
3. Reproducing or selling any part of the app without written consent is prohibited.
4. Using the trademark without permission is prohibited.
5. Posting external links within the app is prohibited.
6. Services must be used within a legal framework.
7. Misuse of the app leads to immediate license termination.
7. Legal Liability
1. Use of the app is at your own risk.
2. You must not misuse the app or its content.
3. You must not post offensive or illegal content.
4. The app may block or cancel accounts of violating users.
5. You agree to indemnify the app for any damages caused by your violations.
6. The app has the right to take legal action against any violations.
8. Amendments
1. Users are obligated to comply with any policy changes.
2. We reserve the right to develop or modify the app and its services.
3. Users may not modify this agreement.
4. Updates to the agreement do not require prior notice.
5. Any additional terms are automatically incorporated into this agreement.
9. Transfer of Rights and Obligations
1. The app may transfer its rights to third parties without objection.
2. Users may not transfer or assign their accounts without written permission.
10. Termination of Agreement
The agreement is automatically terminated in the following cases:
1. Violation of any clause of the agreement.
2. Unauthorized account transfer.
3. Failure to fulfill agreed obligations.
4. Providing unverifiable information.
5. Any activity causing legal disputes.
6. Discontinuation of app operations.
11. Governing Law and Jurisdiction
1. The app is governed by the laws of the State of Palestine.
2. Palestinian courts have exclusive jurisdiction in case of disputes.
3. If any clause is deemed unenforceable, the remaining clauses remain valid.
12. Notifications
1. Notices to the app must be sent via official channels within the app.
2. Notices to users are sent via app, email, or mobile.
13. Special Provisions
1. This policy is an integral part of other agreements.
2. Delivery companies are obligated to maintain confidentiality and integrity.
3. The app will prepare and ship orders according to announced working hours.
4. In case of an order error, it will be replaced free of charge on the first occurrence.
5. Delivery is via Orchestra.ps delivery service.
6. Delivery covers all cities and villages in the West Bank, Jerusalem, and areas of 1948.
7. Delivery time: 2–5 days maximum.
8. Delivery fees:
• West Bank: 20 NIS
• Jerusalem: 30 NIS
• Areas of 1948: 75 NIS
9. Delivery fees and procedures apply to all products displayed.
